people who dont respond should either be kicked or have random time penaltys because im fed up of waiting for them to respond

When a player isn't responding, it means that the game server can't communicate with the player's computer. The possible causes are multiple: their internet is very slow or down, their computer is lagging or crashed, ... When it's caused by an internet issue, it's totally possible that the connection comes back within a few seconds/minutes, in which case the player can carry on playing. That's why the game server waits a few minutes before kicking a non responding player.

When you are playing against a non responding player, there's no other solution than waiting for him to get his connection back or get kicked out.

Also think that if it was you who had connection problems, you would be very glad to be allowed to continue playing your game after your connection gets back.
